Please read these Terms of Service (“Terms”) carefully prior to accessing or using our mobile or desktop application “PINE”, which you can access at https://app.pinetool.ai/attendee or download on App Store or Google Play (hereinafter together referred to as the “Application”). These Terms contain important information about your legal rights and obligations.
Note, by accessing or using the Application, you represent and warrant that you have read, understand, have the legal capacity to and hereby agree to be legally bound by and to comply with these Terms in full. If you do not agree with these Terms, please, do not continue to use the Application.
The Application is operated and owned by PINE Events, Inc. (reg. No. 7046468), registered at 160 Greentree DR STE 101, Dover, Kent, Delaware, 19904, USA (which we may refer to as “PINE”, “we,” “us,” or “our”).
Our collection and use of personal data in connection with your access to and use of the Application is described in our Privacy Notice.
Except as otherwise provided, these Terms are subject to change at any time. In case of material changes affecting your use of the Application or your legal rights as a user of the Application, we’ll notify you prior to the changes’ effective date by posting a notice on the Application or sending a notification to the email provided to us by you. It is your responsibility to check periodically for any changes we make to the Terms. Your continued use of the Application after any changes have been implemented constitutes acceptance by you of such change(s).

These Terms and any policies, including our Privacy Notice and any operating rules posted in Application constitute the entire legally binding agreement and understanding between you (“you“, “user” or the “Attendee”) and PINE, governing your access to and use of the Application (“Agreement”). Our Privacy Notice and other policies applicable to your use of the Application are incorporated by reference into this Agreement.
This Agreement supersedes all prior or contemporaneous communications and proposals, whether oral or written, between the parties with respect to such subject matter.
When you use the Application you hereby declare and warrant that:
- (1) according to your local jurisdiction you are of legal age and eligible to enter into the Agreement;
- (2) according to your local jurisdiction you have no restriction to use the Application;
- (3) you comply with these Terms and all applicable laws and regulations.
A printed version of these Terms shall be admissible in judicial or administrative proceedings based on or relating to use of the Application to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
In order to use the full range of features offered by PINE you may register a personalized account (“Account”) by providing your email address and creating a password. You agree to receive to the indicated address a confirmation email to complete the authorization and a recovery link in case you forget your password.
There is an option to log in to the Account by using third-party accounts, such as Google and Apple. Please note that if you choose to use such an account to log in to our Application, you are subject to the Terms of Service and Privacy Policies of such third parties.
You must provide accurate, current and complete information during the registration process and keep your profile information up-to-date at all times. More information about your data see in our Privacy Notice.
You understand and hereby agree that your profile information will be accessible to other users of the Application attending the same Event, unless you use the “Incognito Mode”, if available (the feature that makes you “invisible” to the other users, except for those you send an invitation to meet).
By registering an Account on behalf of a legal entity you represent and warrant that you have the authority to legally bind that entity and grant us all permissions and licenses provided in these Terms. By publishing any information about any legal entity you further warrant that you are fully authorized and empowered to disclose that information through the Application and you are solely responsible for its accuracy and credibility.
You may not transfer or assign your account. You are solely responsible for maintaining the confidentiality of your login credentials you use to sign up for the Application, and for all activities that occur under those credentials. It is your responsibility to ensure that your use of the Application and Account does not contravene any applicable laws, rules, or regulations.
If you know or have any reason to suspect that someone has gained access to your Account without your authorization, or your credentials have been lost, stolen, misappropriated, or otherwise compromised, please immediately notify PINE to the following email: firstname.lastname@example.org.
To irreversibly terminate your Account, please, forward the request at email@example.com and we will take all the necessary actions.
PINE provides its users through the Application with a set of networking features (the “Services”) enabling users to:
- see the schedule and map of the events,
- get acquainted, communicate and meet other users,
- share content and ideas,
- receive push notifications from the Organizer,
- participate in live polling and session rating
- use other features as set by the Organizers for their events.
The functionality of events’ profiles may differ as it is set by the event Organizers. PINE Events, Inc. does not participate in creation, organization or hosting of any events and does not sell any tickets to such events, unless it is expressly stated otherwise in the description of an Event.
Currently all PINE Services rendered through the Application are free of charge for the Attendees. However, we may in the future charge a fee for certain features and/or uses. You will not be charged for any such uses of the Services unless you first agree to such charges. Possible payment information and payment methods will be in advance specified and presented through the Application.
Depending on the Organizer’s decision some events may be private or public:
- To find a private event, you should use the event code distributed by the Organizer. Please contact the Organizer to get the event code and participate in the private event.
- To find a public event, please ensure that the Organizer of such event uses the Application.
- You can get an invitation to the event to your email, in case the Organizer provided it to us.
Content and communication with users
PINE enables the Attendees to interact with each other and the Organizers by posting messages in Activity Stream or sharing private messages through PINE messenger. Please note that your content sharing and communication shall be subject to section “Content and intellectual property rights” hereof.
The Application is designed for its users to connect and network with each other by setting up meetings during the events. You will have access to the convenient schedule of meetings at locations as offered by the event Organizer. You can share such calendars with other users of the Application. Please remember:
- your meeting and communication with other users is subject to their express consent – confirmation of your request;
- you should always exercise due diligence and care when meeting and sharing your data with other users.
Content and intellectual property rights
The Application is owned and controlled by PINE Events, Inc.. Unless otherwise agreed in writing, all materials in the Application, including text, graphics, information, images, designs, icons, photographs, video, sounds, music, computer code, any other materials and the intellectual property rights in such materials (collectively, the “Content”), are owned, controlled and/or licensed by PINE or included in the Application with the permission of the relevant owner and are protected by copyright and other national and international intellectual property rights.
Certain trademarks, trade names and logos used or displayed in the Application are registered and unregistered trademarks and trade names of PINE and/or of relevant holder(s) and may not be copied, imitated or used, in whole or in part, without the prior written permission of PINE or the applicable trademark holder(s). In case you download or copy the Content and other downloadable materials displayed in the Application, no right, title or interest in any downloaded or copied Content is transferred to you as a result of any such downloading or copying. You agree not to change or delete any ownership notices from materials downloaded or printed from the Application.
Subject to your compliance with these Terms, PINE grants you a limited, personal, non-exclusive, non-sublicensable, revocable, non-transferable, worldwide license to (i) access and use the Application on your personal device(s) in the manner provided for in these Terms; and (ii) access and view any Content made available in or through the Application and accessible to you.
Without the prior written permission of PINE, you may not frame, or make it appear that a third-party website or service is presenting or endorsing, any of the Content, or incorporate any intellectual property of PINE, the users of the Application or any of their licensors into another website or other service.
To request permission to place a link on your website to enable users to click through from your website to the Application, please send your name, address, website URL, and nature of the website to firstname.lastname@example.org.
PINE reserves the right to monitor your use and to alter or revoke this license or your access to the Content at any time and for any reason without prior notice. PINE allowing you this limited use does not constitute a waiver of any of PINE’s rights to the Content. You are also advised that we are determined to enforce our intellectual property rights to the fullest extent of the law, including through civil remedies and criminal prosecution.
When using the Application the users may:
- (1) download, create, display, publish and distribute materials, including trademarks, logos, trade names, texts, images, designs, graphics, icons or other materials and information (“User Content”),
- (2) access and view the Content downloaded, published, distributed, displayed by other users of the Application, by the Organizers and any Content that PINE itself makes available through the Application.
For the purposes provided in these Terms as between you and PINE, you own User Content and information that you submit or post to the Application, and you are only granting PINE and our affiliates for a period of your Account existence a limited, revocable, non-exclusive, sub-licensable, transferable, royalty-free, worldwide license to access, use, copy, modify, distribute, publish, store, cache and process the information and User Content that you provide through the Application, without any further consent, notice and/or compensation to you or others.
When you create or make available any User Content, you thereby represent and warrant that:
- The creation, distribution, public display and the accessing, downloading, or copying of such User Content does not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.
- You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us and other users of PINE to use your User Content in any manner contemplated by PINE and these Terms;
- You are solely responsible for all the personal data that may appear in your User Content (such as an address, pictures of any people, their telephone numbers, etc.)
You are prohibited to use the Application and PINE Services in any manner not expressly authorised by these Terms, including without limitation:
- submitting Content that is offensive to the online community, such as content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
- engaging in activity that involves the transmission of “junk mail” or unsolicited mass mailing or “spam” or harvesting or otherwise collecting personally identifiable information about users, including names, phone numbers, addresses, email addresses without users’ prior consent;
- engaging in activity, or submitting Content, or promoting information that is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
- submitting Content that displays pornographic or sexually explicit material of any kind;
- submitting Content that contains viruses, Trojan horses, worms, or any other similar forms of malware;
- engaging in unauthorized commercial activities and/or sales without our prior written consent such as advertising, solicitations, contests, sweepstakes, barter, and pyramid schemes;
- using any robot, spider, other automatic device, or manual process to monitor, copy, or “scrape” web pages or the content contained in the Application or for any other unauthorized purpose without our prior written consent.
PINE may, but is not obliged to, control, is not responsible for, and makes no representations or warranties with respect to any Content. You must conduct any necessary, appropriate, prudent or judicious investigation, inquiry, research, and due diligence with respect to any Content. You are solely responsible for any User Content you download to PINE.
If you’re a copyright owner or an agent of a copyright owner and believe that any Content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing PINE Events, Inc. with the following information in writing, (pursuant to 17 U.S.C. 512(c)(3)):
- A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest;
- A description of the copyrighted work that you claim has been infringed upon;
- A description of where the material that you claim is infringing is located in PINE;
- Your address, telephone number, and email address;
- A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

You acknowledge that if you fail to comply with all of the requirements of this section, your DMCA notice may not be valid.
Links to third-party websites
Some features of the Application may be made available or accessed in connection with third-party services and content that PINE does not control. The Application may contain links or frame hyperlinks to other websites, some of which are governed by third parties. These links are provided as a convenience to you and as an additional avenue of access to the information contained therein.
We have not necessarily reviewed all the information on those other websites and are not responsible for the content of those or any other website or any products or services that may be offered through those or any other website. Inclusion of links to other website should not be viewed as an endorsement of the content of linked website. Users use such third-party content contained therein at their own risk. We are not responsible for any losses, damages or other liabilities incurred as a result of your use of any linked website.
Warranties and disclaimers
Other than as expressly set out in these Terms or any our policies, PINE does not make any specific promises about the Application and the Services. The information, materials and Services provided through the Application are provided “as is” and “as available”.
To the fullest extent permitted by law, PINE disclaims all warranties, express or implied, regarding the Application, content and any products or services you may obtain or access through the Application, including, but not limited to, implied warranties of title, merchantability, fitness for a particular purpose and non-infringement of intellectual property.
You understand that PINE does not participate in creation, organization or hosting of any events and does not sell any tickets to such events. PINE does not guarantee that any Event will actually occur, that any user will be able to attend any Event or that it will be held by the Organizer in the manner described in the Application. PINE does not endorse any Organizer, Attendee, Event or user.
PINE does not guarantee that the Application will be uninterrupted or error-free, that any defects will be corrected, or that the Application is free of viruses or anything else harmful.
Limitation of liability
PINE Events, Inc. is not responsible if any information, User Content, listings available on or though this Application are inaccurate or incomplete, as well as for typographical errors or omissions relating to text or photography. We are not making any promises of any kind, including about the Application’s accuracy, adequacy, usefulness, reliability, legality or otherwise. You agree that it is your responsibility to monitor any changes to the material and the information contained in the Application.
You accept sole responsibility for the legality of your actions under laws applying to you and the legality of any item(s) you post in the Application.
In no event shall PINE, its directors, members, employees or agents be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost data, personal injury or property damage related to, in connection with, or otherwise resulting from any use or inability to use the Application, including, without limitation, any damages caused by or resulting from reliance by a user on any information obtained through the Application, or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission or any failure of performance, even if PINE has been advised of the possibility of such damages.
PINE shall not be liable for any damages, liability or losses arising out of any transaction or relationship between you and other user or Third-Party services provider, whether or not PINE has been advised of the possibility of such damages.
The foregoing limitations of liability do not apply to the extent prohibited by law. Please refer to your local laws for any such prohibitions.
If any part of the warranty disclaimers or limitations of liability is found to be invalid or unenforceable for any reason or if we are otherwise found to be liable to you in any manner, then our aggregate liability for all claims under such circumstances for liabilities, shall not exceed the total amount of payments made by you to PINE within one year preceding the claim.
You agree to defend, indemnify and hold harmless PINE Events, Inc., its officers, directors, employees, business partners and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ fees) arising from: (i) any breach by you of any of these Terms, (ii) your use/misuse of content or features available in the Application or (iii) a violation by you of applicable law or any agreement or terms with a third party to which you are subject.
You also agree to reimburse PINE for any damage, loss, cost or expense PINE incurs (including fees or costs of attorneys, accountants, professional advisors, and other experts incurred in connection with the defense or settlement of the foregoing) because of your use of the Application for any unlawful or prohibited purpose.
We reserve the right to handle our legal defense however we see fit, including instances when you are indemnifying us. Therefore, you agree to cooperate with us so we execute our strategy.
Applicable law and jurisdiction
Except as otherwise set forth in these Terms or any policies, these Terms shall be exclusively governed by and construed in accordance with the laws of the State of Delaware and the USA, excluding its rules on conflicts of laws.
The Application has been designed to comply with the laws of the State of Delaware and the USA. If any material in the Application, or your use of the Application, is contrary to the laws of the place where you are when you access it, the Application is not intended for you, and we ask you not to use the Application. You are responsible for informing yourself of the laws of your jurisdiction and complying with them.
Except where prohibited by applicable law, and without limitation to any statutory rights for consumers, you agree that any dispute, conflict, claim or controversy directly or indirectly arising out of or broadly in connection with or relating to the Application or these Terms, including, without limitation, those relating to its validity, its construction or its enforceability (any “Dispute”) shall be resolved by means of amicable negotiations directly with PINE team in accordance with the principles of good faith and cooperation. If the consensus may not be reached by the negotiations, the Dispute shall be settled exclusively in the state courts of the State of Delaware, subject to its jurisdiction rules, with applicable substantive law of the State of Delaware and the USA.
All claims shall be brought within one (1) year after the claim arises, except to the extent a longer period is required by applicable law.
By using PINE, you understand and agree that we may send you via email, push notifications or PINE bot the communications or data from the Application, including but not limited to (i) notices about Services used or requested by you; (ii) updates and information or materials regarding your Account.
Note, however, that some email messages may be more “commercial” in nature than others, as they may advertise a feature of the Application or our merchandise or a service or event in which we believe you may be interested, or may otherwise discuss a marketing campaign or promotion offered by PINE.
We will give you the opportunity to unsubscribe from receiving these commercial emails from us by following the instructions provided in such message(s).
Term and termination
Termination by PINE. We reserve the right, at any time at our sole discretion, to: modify, suspend or discontinue the Application, content, feature or offers through the Application, with or without notice; and/or offer or cancel opportunities to some or all users of the Application. You agree that we shall not be liable to you or to any third party should any of the foregoing occur with respect to the Application.
PINE reserves the right to take whatever lawful actions it may deem appropriate in response to actual or suspected violations of these Terms, including, without limitation, the suspension or termination of your access and/or Account. PINE may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong.
Termination by you. You may terminate this agreement with PINE at any time by deleting your Account as set forth in section “Account registration” herein and no longer accessing or using the Application. If you close your Account, all licenses granted in these Terms will immediately terminate. We may delete all data associated with your Account and activity from our servers without liability or obligation to you.
Headings of provisions are for convenience only and shall not be used to limit or construe any provisions of these Terms.
If any provision of these Terms is determined to be unlawful, void or unenforceable, the remaining provisions of these Terms will continue to be fully valid, binding and enforceable.
We may transfer our rights and obligations under these Terms to third party, but this will not affect your rights or our obligations hereunder. You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.
